Important announcement from the Dog Legislation Council of Canada, and the rest of the Banned Aid Coalition!!

For those of you out there who know about Ontario’s Pit Bull Ban, Banned Aid has set forth a Legal Challenge with the help of Lawyer Clayton Ruby, in the hopes of bringing this ridiculous piece of legislation down!

As a member of the DLCC, it is my duty to pass on this information; our legal challenge is in jeopardy!! The government has filed a motion with the courts that could easily destroy everything that we’ve worked so very hard to accomplish! They are getting scared, they know that we are winning, and they are doing everything in their power to stall. And they are using our own tax dollars against us to do it! They are hoping that we will give up due to lack of funds!

We still owe an outstanding $100,000 and this motion will cost an additional $50,000! Our lawyers wish to have the outstanding debt paid before they go any further in responding to the motion. This amount is due by the end of the first week of October.

Right now we need the help of dog lovers EVERYWHERE more than ever! Many people do not fully understand the consequences of this ban. This issue is not just about “pit bulls.” It effects ALL dog breeds, and ALL dog owners, as many mixed breed dogs are targeted as well, and any other breed deemed “vicious” can be added to the list next. First “pit bulls.” Next it could be Rottweilers, Dobermans, German Shepherds, Mastiffs, Akitas, Malamutes, Huskies. There is no limit.

This is also about Human Rights. A Peace Officer can now enter your home without a warrant, just on the suspicion alone that you might have a “dangerous dog,” and are allowed to seize and destroy said dog just based on breed alone. In Ontario, you are now Guilty until proven Innocent, if you are charged. People are now being treated as second-class citizens and criminals, just because of the shape of their breed of choice. Even visitors, just passing through Ontario who own a banned breed can have their dogs confiscated!

“Some of you will remember in previous posts, I vacationed and trained (SAR) with my dog in Ontario over the summer.

“I had called customs and was assured that I could bring my dog through Ontario, or that I could vacation in Ontario as long as I complied with leash and muzzle requirements.

“According to the response below, they were wrong. That was a mistake that could have costed me my dog's life, among other consequences. So, ladies and gentlemen, the plot thickens. I will be writing more letters in the future...”

Attorney Generals Office Response -

“Dear Mr. X:

”Thank you for your correspondence of September 13, 2006, regarding the Public Safety Related to Dogs Statute Law Amendment Act, 2005.

“The Public Safety Related to Dogs Statute Law Amendment Act, 2005 primarily amends the Dog Owners' Liability Act (DOLA). As you know, the legislation bans pit bulls, places restrictions on existing pit bulls and toughens the penalties for the owners of any dog that poses a danger to the public. The new legislation came into force on August 29, 2005. You can find a copy of the DOLA, as amended, and its regulations at:

“Individuals who owned pit bulls in Ontario prior to August 29, 2005, are legally allowed to keep their existing dogs. However, those owners are required to comply with new requirements such as leashing and muzzling their pit bulls and having their dogs spayed or neutered. Pit bull owners had until October 28, 2005, to comply with the leashing, muzzling, and sterilization requirements.

“Except for some narrow exceptions allowing temporary entry for dog shows, importing pit bulls into Ontario is prohibited. Pit bulls not legally resident in Ontario prior to August 29, 2005, are subject to seizure. Individuals found to have imported a pit bull into Ontario will be in violation of the law and may be subject to fines and/or jail. There are no exceptions for tourists, including those simply passing through Ontario with their pit bulls. To be clear, it is this Ministry's view that individuals merely traveling through Ontario with pit bulls-even for short periods of time-would be in contravention of the DOLA.

“The Ministry cannot provide opinions as to whether or not individual dogs are included in the definition of pit bull set out in DOLA. The legislation specifically indicates that a pit bull is (a) a pit bull terrier, (b) a Staffordshire bull terrier, (c) an American Staffordshire terrier, (d) an American pit bull terrier, (e) a dog that has an appearance and physical characteristics that are substantially similar to those of dogs referred to in any of clauses (a) to (d). Section 1(2) of DOLA provides that when making determinations as to whether or not a dog is a pit bull within the meaning of DOLA, the courts will be able to have regard to the breed standards for Staffordshire Bull Terriers, American Staffordshire Terriers or American Pit Bull Terriers as established by the Canadian Kennel Club, the United Kennel Club, the American Kennel Club or the American Dog Breeders Association.

This week, I have sent out $600 to this cause, (FYI, this was almost all of the Commission Money I had made at Anthrocon this year!) and I will be going out in my neighborhood this week and next week asking for donations.

I am now turning to the Furry Community for help! You guys are animal lovers, and some of the most generous people that I know! Just think of all of the money we as Furs have raised at past conventions, at Charity Auctions! If you believe that this ban is wrong, PLEASE DONATE TO THE LEGAL CHALLENGE!!! Even if you can only donate $5 or $10, that is still $5 or $10 more than we had before! No donation is too small!

I had hoped to plan a group portfolio project to raise funds for this cause, but it is looking like we won’t have the time for that right now. So to the Artists out there, I ask if you could please consider donating a % from Commissions, or FurBid auctions, if you can afford it! Every bit counts!
